Terms and conditions of use

The present terms and conditions of use are concluded on the one hand by the company Murs d'Afrique exempted from registration in the Registre du Commerce et des Sociétés( RCS) in application of the article L123-1-1 of the Commercial law and on the other hand, by any natural or legal entity wishing to proceed to a purchase via the website of Murs d'Afrique.

1. Object

The present terms and conditions of use aim at defining the contractual relations between Murs d'Afrique and the buyer and the conditions applicable to any purchase made on this website. The purchase of an item hrough the present site implies an unconditional acceptance by the buyer of the present terms of use.

These terms and conditions of use will prevail over quite other general or particular conditions. Murs d'Afrique can modify its terms of use at any time. In that case, the applicable conditions will be the right ones in the date of the order by the buyer.

2. Characteristics of the proposed products

The products are the ones which appear in the catalog published in the site of Murs d'Afrique. The photos of the catalog are the most accurate possible but cannot be as perfect as the reality, especially the color.

3. Prices

The prices in the catalog are subjected to the VAT according the art. 293 B of the CGI. Murs d'Afrique can modify its prices. Prices appearing in the catalog the day of the command will be the only ones applicable to the buyer. The indicated prices don't include shipping charges. These will be displayed when the order will be made by the buyer.

4. Geographical area

The products presented in the site is reserved for the buyers who live in the European Union, Switzerland and Norway for deliveries required in these geographical zones.

5. Orders

Buyers must:

- Create an account or enter their email address and password if they are already users;

- Validate their order after having checked it;

- Make the payment in the planned conditions;

- Confirm their order and their payment. The confirmation of the order involves the acceptance of the present conditions of use.

6. Cooling-off period and Return

The customer has a cooling-off period of 7 working days as from the delivery of their order to make return of the product for an exchange or a refund without any penalty, except the expenses of return. These last ones are refundable only in case of error of delivery of Murs d'Afrique. According to the terms and conditions of use only items returned with their original packing will be accepted. Consequently returns of washed or damaged products will be refused.The buyer has to save his return first through his account as it is explained in "Shipping and Return".

You must join a photocopy of your invoice. An answer will be given to you by e-mail within 72 hours. If there is a refund, it will happen within 30 days.

7. Payment

Payments will be made by bank card, transfer or check. Credit card payments will be realized by means of the secured system Paypal whcih uses the SSL (Secure Socket Layer) protocol so that information is coded by a software and anyone can't acquaint with it during the transport on the network.

8. Shipping

Orders are shipped to the address indicated in the order form. Your package will be dispatched at your own risk from the moment when products left the premises of Murs d'Afrique. In case of damage during the transport, the buyer must formulate a protest to the carrier within three days as from the delivery. The delivery deadlines are given only as a rough guide; if these overtake thirty days as from the order, the sale contract can be cancelled and buyer can be paid off.

By default, Murs d'Afrique will consider an order as delivered three working days after the shipping. The status of the order will be"Delivered" in the "Order History". This status will allow the buyer to make a return of his order if he wants, as it is explained in the block Information "Delivery and Return".

9. Guarantee

All the products supplied by the salesman have the legal guarantee planned by articles 1641 and following ones of the Civil code. In case of non-conformity of a sold product, it can be returned to the salesman who will exchange it or will pay it off.

10. Responsibility

The salesman is not responsible for any damage caused by the use of the Internet network such as loss of data, virus, break of the service, or the other involuntary problems.

11. Intellectual property

All the elements of Murs d'Afrique are and remain the intellectual and exclusive property of Murs d'Afrique. Nobody is authorized to reproduce, to exploit, to rerun, or to use whatever title it is, even partially, elements of the site : software, visual or sound. Any simple link or hypertext link is strictly forbidden without an agreement written by Murs d'Afrique.

12. Personal data

According to the law relative to the computing, to the files and to the liberties of January 6th, 1978, information relative to the buyers can be the object of an automated treatment. Murs d’Afrique has the right to collect information on the buyers including by using cookies, and, if they wish it, to pass on to commercial partners the collected information. The buyers can oppose to the disclosure of their address and phone number by indicating it to Murs d’Afrique. The users also have a right of access and rectification of the data concerning them, according to the law of January 6th, 1978.

13. Filing - Proof

Murs d’Afrique will archive order forms and invoices on a reliable and sustainable support establishing a right copy according to the article 1348 of the Civil code. Registers computerized by Murs d’Afrique will be considered as a proof of the communications, the orders, payments and transactions which happen between the customer and Murs d'Afrique.

14. Regulation of the disputes

The present terms and conditions of use are subjected to the French law. In case of dispute, skills are give to courts of Paris.
